this american life: habeas schmabeas

habeas schmabeas
this is a really nice piece about habeas corpus focusing mostly on gitmo and the detainee question... this is the set up.. and then it gets into the real meat- habeas corpus... its right to live right and to do right... and for me honestly applied habeas corpus laws are a good way to do that...

The situation is truly troubling. With power comes great responsibility; our government needs to check itsself.

i think that this is lost on people...

our government needs to check itself

its one of the principle aspects of american democracy... its not a radical idea.. its not a leftist contraversion... its the way its supposed to work...

the other thing that is lost on people is that the purpose of a republican democracy is not "majority rule"... it was actually concieved to give power to and preserve the will of the minority...

Lincoln suspended Habeus Corpus during the Civil War. just an interesting fact, I thought. Did you listen to NPR over the weekend, big story on the whole detainee, interrogation, etc, mess that we've created?
